THE CODE OF CIVIL PROCEDURE, 1908

ACT NO. 5 OF 19081                      [21st March, 1908.]

An Act to consolidate and amend the laws relating to the procedure of the Courts of Civil Judicature.

WHEREAS it is expedient to consolidate and amend the laws relating to the procedure of the Courts of Civil Judicature : It is hereby enacted as follows : —

Part - 1

Section - 26. 

Institution of suits. — 

(1) Every suit shall be instituted by the presentation of a plaint or in such other manner as may be prescribed.

(2) In every plaint, facts shall be proved by affidavit:]

Provided that such an affidavit shall be in the form and manner as prescribed under Order VI of rule 15A.

धारा - 26.

वादों का संस्थापन। -

(1) प्रत्येक वाद एक वादपत्र प्रस्तुत करके या ऐसी अन्य रीति से, जो विहित की जाए, संस्थित किया जाएगा।

(2) प्रत्येक वाद में, तथ्यों को शपथ पत्र द्वारा सिद्ध किया जाएगा:]

बशर्ते कि ऐसा शपथ पत्र नियम 15ए के आदेश VI के तहत निर्धारित रूप और तरीके से होगा।
