THE CODE OF CIVIL PROCEDURE, 1908

ACT NO. 5 OF 19081                      [21st March, 1908.]

An Act to consolidate and amend the laws relating to the procedure of the Courts of Civil Judicature.

WHEREAS it is expedient to consolidate and amend the laws relating to the procedure of the Courts of Civil Judicature : It is hereby enacted as follows : —

Part - 1

Section - 17.

Suits for immovable property situate within jurisdiction of different Courts.—

Where a suit is to obtain relief respecting, or compensation for wrong to, immovable property situate within the jurisdiction of different Courts. the suit may be instituted in any Court within the local limits of whose jurisdiction any portion of the property is situate :

Provided that, in respect of the value of the subject-matter of the suit, the entire claim is cognizable by such Court.

विभिन्न न्यायालयों के अधिकार क्षेत्र में स्थित अचल संपत्ति के लिए वाद-

जहां एक मुकदमा विभिन्न न्यायालयों के अधिकार क्षेत्र में स्थित अचल संपत्ति के संबंध में राहत, या गलत के लिए मुआवजा प्राप्त करने के लिए है। मुकदमा किसी भी न्यायालय में स्थानीय सीमाओं के भीतर स्थापित किया जा सकता है जिसके अधिकार क्षेत्र में संपत्ति का कोई भी हिस्सा स्थित है:

बशर्ते कि, वाद की विषय-वस्तु के मूल्य के संबंध में, संपूर्ण दावा ऐसे न्यायालय द्वारा संज्ञेय हो।
